Attorney John B. Wells, Executive Director of the Military-Veterans Advocacy, Inc. is one of the leading advocates in the nation for the Blue Water Navy Vietnam Veterans. That group of veterans has been in a struggle with the VA for years over getting equity for Agent Orange benefits. The struggle began in 2002 when the VA decreed the only Vietnam Veterans eligible for Agent Orange benefits with those with boots on the ground.
John Wells is leading the way in the arena of judicial combat with the VA over the issue of obtaining equity for the Blue Water Navy Vietnam Veterans. His association headquarters and law practice are located in Slidell, Louisiana yet he spends much time in Washington D.C. meeting with senators, representatives and VA officials including Sloane Gibson, the Deputy Secretary of the VA.
After recently meeting with VA officials he received confirmation that the VA will make no changes to their Blue Water Navy policy, effectively excluding tens of thousands of veterans from earned disability benefits. Wells states “In doing so they have defied the United States Court of Appeals for Veterans Claims, the United States Congress and have again breached faith with tens of thousands of veterans.” Needless to say he was greatly disappointed by the VA’s position on the matter and intends to fight even harder to obtain fairness for the Blue Water Navy Vietnam Veterans.
On March 10 he will be presenting important an oral argument at the Court of Appeals for the District of Columbia to ascertain whether the federal district court has the ability to review the VA actions under the Administrative Procedures Act. He is inviting anyone with an interest in the issue to accompany him in a show of support as he presents his case. The location is at the federal Court of Appeals for the DC Circuit, 333 Constitution Ave., NW Washington DC and it starts at 9:30 am. In addition he has three court cases pending in the Court of Appeals for Veterans Claims. One case concerns Da Nang Harbor, another Nha Trang Harbor and the third the territorial seas. His intention with these cases is to point out to the court how the VA has defied them.
